This Privacy Policy describes how 1031 DST (“we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit 1031dstinvestment.org (the “Site”) or interact with our services. By using the Site, you agree to the practices described in this policy.

This policy applies to information collected through the Site, including through contact forms, consultation request forms, calendar booking tools, email communications, and our customer relationship management system. It does not apply to information collected through third-party websites that we may link to from the Site.

Information We Collect

We collect personal information that you voluntarily provide, as well as certain information collected automatically when you visit the Site.

Information You Provide Directly

We collect information you submit through forms, consultation requests, calendar bookings, and email communications. This typically includes:

  • Contact information: full name, email address, phone number, mailing address.
  • Investment-related information: sale price of relinquished property, expected timing of a 1031 exchange, debt level, accredited investor status, investment goals, and other details you choose to share.
  • Professional contacts: information about your CPA, attorney, qualified intermediary, or other professional advisors involved in your 1031 exchange.
  • Communications: the content of emails, form submissions, and other communications you send to us.

You are not required to provide this information, but some of it is necessary for us to respond to your inquiry, schedule a consultation, or evaluate whether a Delaware statutory trust 1031 exchange may be appropriate for your situation.

Information Collected Automatically

When you visit the Site, we automatically collect certain technical information about your visit. This typically includes:

  • Device and browser information: IP address, browser type and version, device type, operating system.
  • Usage information: pages visited, time spent on each page, links clicked, referring website, search terms used to find the Site.
  • Approximate location: geographic region inferred from your IP address (typically at the city or state level, not precise location).

This information is collected through Google Analytics 4 and standard web server logs. See the “Cookies and Tracking Technologies” section below for more detail.

How We Use Your Information

We use the information we collect for the following purposes:

  • To respond to your inquiries, schedule consultations, and provide the services you request.
  • To communicate with you about 1031 exchanges, DST offerings, and related topics that may be relevant to your stated interests.
  • To coordinate with your qualified intermediary, CPA, attorney, and other professional advisors when you have given us authorization to do so.
  • To send periodic email communications, including educational content, market updates, and notifications about new DST offerings or relevant resources. You may unsubscribe from email communications at any time using the unsubscribe link in any email.
  • To improve the Site, understand how visitors use the Site, and develop content that better serves our audience.
  • To comply with applicable legal, regulatory, and broker-dealer compliance requirements, including under FINRA and SEC rules.
  • To detect, investigate, and prevent fraud, security breaches, or other harmful activity.

We do not sell your personal information to third parties for monetary consideration. We do not use your information for purposes unrelated to those described above without your consent.

How We Share Your Information

We share personal information only as described below.

Service Providers

We share information with third-party service providers that help us operate the Site, communicate with you, and provide our services. These include:

  • Website hosting and infrastructure providers.
  • Email and marketing automation platforms used to send consultation confirmations, educational content, and other communications.
  • Calendar booking and scheduling tools.
  • Customer relationship management (CRM) software used to maintain records of consultations and ongoing client communications.
  • Analytics providers (Google Analytics 4) that help us understand Site usage.

Service providers are contractually obligated to use personal information only for the purposes we authorize and to maintain appropriate security.

Broker-Dealer and Compliance Sharing

As a firm offering services related to securities (specifically Delaware statutory trust 1031 offerings), we share information as required with our broker-dealer of record, for compliance, supervision, and recordkeeping purposes. This sharing is required by FINRA and SEC regulations.

DST Sponsors and Qualified Intermediaries

When you proceed with a specific DST subscription or 1031 exchange, we share necessary information with the relevant DST sponsor and your qualified intermediary to complete the transaction. We share this information only with your knowledge and consent, and only what is necessary to execute the transaction you have requested.

Professional Advisors

With your authorization, we may coordinate with your CPA, attorney, or other professional advisors. We share information with these parties only with your express permission.

Legal Requirements

We may disclose personal information when required by law, court order, subpoena, regulatory investigation, or other legal process. We may also disclose information to protect the rights, property, or safety of 1031 DST, our clients, or others, including to investigate suspected fraud or violation of our terms.

Business Transfers

If 1031 DST is involved in a merger, acquisition, sale of assets, or similar corporate transaction, your personal information may be transferred as part of that transaction. We will provide notice on the Site or by email before any transfer occurs and before your information becomes subject to a different privacy policy.

Cookies and Tracking Technologies

The Site uses cookies and similar tracking technologies to provide functionality, analyze usage, and improve your experience. The specific technologies in use are:

Essential Cookies

Some cookies are necessary for the Site to function, including cookies that maintain your session, support form submissions, and remember preferences. These cannot be disabled without affecting Site functionality.

Analytics Cookies

We use Google Analytics 4 to understand how visitors interact with the Site. Google Analytics 4 uses cookies to collect information including pages visited, time spent on pages, traffic sources, and approximate location. This information is aggregated and used to improve the Site. We have configured Google Analytics 4 to anonymize IP addresses where supported by the service.

You can opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-on, available at tools.google.com/dlpage/gaoptout. You can also adjust cookie settings in your browser to refuse cookies or alert you when cookies are being sent.

Browser Controls

Most browsers allow you to view, manage, delete, and block cookies. Refer to your browser’s help documentation for instructions specific to your browser. Disabling cookies may affect Site functionality.

Do Not Track Signals

Some browsers offer a “Do Not Track” (DNT) signal. The Site does not currently respond to DNT signals because there is no industry standard for how to interpret them. We address tracking through the cookie controls and opt-out mechanisms described above.

We implement reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, disclosure, alteration, or destruction. These include encrypted data transmission for forms submitted through the Site, access controls limiting who at our firm can view client information, and secure storage practices with our service providers.

No method of transmission over the internet or method of electronic storage is completely secure. While we work to protect your personal information, we cannot guarantee absolute security. You are responsible for protecting your account credentials and for the security of any device you use to access the Site.

The Site may contain links to third-party websites, including sponsor websites, regulatory agency websites, and resource sites referenced in our articles.
